One (1) -Year Limited Warranty
By using your Nitetronic or goodnite™ products, you agree to be bound by all terms of this One (1)-Year Limited Warranty as stated below.
WHAT IS COVERED BY THE WARRANTY?
The Warranty is non-transferable and is valid only for the Original Purchaser of the product. An Original Purchaser is one who purchases the Nitetronic Product directly from Nitetronic or from an authorized retailer of Nitetronic.
HOW LONG DOES THE WARRANTY COVERAGE LAST?
The Warranty lasts for a period of One (1) Year from the date of original retail purchase. This One (1) Year period shall not be extended if the product was repaired or replaced during the original One (1) Year Warranty Period.
WHAT IS NOT COVERED BY THE WARRANTY?
The Warranty does not apply to products that are not Nitetronic or goodniteTM Products. The Warranty does not cover damage from normal wear and tear, abuse, or misuse. The Warranty does not apply unless the Original Purchaser makes the warranty claim. Warranty return shipping costs will be covered by Nitetronic via return shipping label provided to the customer.
HOW CONSUMER LAW RELATES TO THE WARRANTY
The Warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Other than as permitted by law, Nitetronic does not exclude, limit or suspend other rights you may have. For a full understanding of your rights, consult the laws of your state.
WARRANTY LIMITATION SUBJECT TO CONSUMER LAW
To the extent permitted by law, with respect to all other warranties, remedies and conditions, whether statutory, express or implied, including, without limitation, warranties of merchantability and fitness for a particular purpose, and warranties against hidden or latent defects, Nitetronic limits the duration and remedies of such warranties to the duration of this One (1) Year Limited Warranty and, at Nitetronic’s option, the repair or replacement of Nitetronic Products as described herein.
Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
HOW TO OBTAIN WARRANTY SERVICE
To be eligible for service under the Warranty, you MUST download, completely fill out and submit the Warranty Service Request Form to Nitetronic.
Upon receipt of a valid warranty claim, Nitetronic will issue a Return Merchandise Authorization (“RMA”) number for you to write on the warranty service request form.
Your warranty claim will not be valid and will not be honored unless you do ALL of the following:
- Fully complete and submit the Warranty Service Request Form to Nitetronic within One (1) Year from the date of original retail purchase
- When received, include the RMA number on Warranty Service Request Form
- Include the product, warranty service request from with RMA number, and valid proof of purchase in the package
Upon receipt of your Nitetronic Product, accompanied by the RMA number and valid proof of purchase, Nitetronic will inspect the Nitetronic Product within two (2) weeks, and repair or replace it at Nitetronic’s option.
Warranty service will only be provided if all items on the inspection checklist are determined to be true upon inspection.
LIMITATION OF LIABILITY
Except as provided in the Warranty and to the maximum extent permitted by law, Nitetronic is not responsible for direct, special, incidental or consequential damages resulting from any breach of warranty, or under any other legal theory, including without limitation, loss of use.
No Nitetronic re-seller, authorized retailer, agent, or employee is authorized to make any modification, extension, or addition to the Warranty. If any term of the Warranty is found to be illegal or unenforceable, the legality and enforce-ability of all remaining terms shall not be affected or impaired. The Warranty is governed by and construed under the laws of the country in which the Nitetronic Product’s original retail purchase took place. Nitetronic, or its successor in interest, is the warrantor under the Warranty.
